Welcome to Dashfit Private Limited (“Dashfit”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and services (collectively, the “Platform”). By registering, purchasing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Services
1.1 Dashfit provides access to digital fitness programs, workout challenges, and wellness-related content on a subscription or pay-per-use basis.
1.2 Our services are intended for general fitness and lifestyle purposes only. Dashfit does not provide medical advice, clinical diagnosis, or treatment of any kind.
1.3 We reserve the right to update, modify, or discontinue any aspect of the Platform at our sole discretion.
2. Eligibility
2.1 You must be at least 18 years of age to use the Platform. If you are under 18, you must use the Platform only under the supervision of a parent or legal guardian.
2.2 By using the Platform, you represent that you are legally competent to enter into these Terms and that the information you provide is accurate and complete.
3. Health Disclaimer
3.1 Participation in fitness activities involves risks. You acknowledge and agree that:
(a) you are solely responsible for assessing your fitness level;
(b) if you have any medical condition, injury, pregnancy, or health concern, you must obtain medical clearance before starting any program;
(c) Dashfit is not liable for any injuries, accidents, or health complications arising from your use of the Platform.
3.2 By using the Platform, you voluntarily assume all risks associated with physical activity.
4. Account Registration
4.1 To access certain features, you may be required to create an account. You agree to:
(a) provide accurate information;
(b) maintain the confidentiality of your account credentials; and
(c) accept responsibility for all activities under your account.
4.2 Sharing accounts, impersonation, or unauthorized access is strictly prohibited.
5. Payments and Refund Policy
5.1 All purchases are payable in advance through the payment methods available on the Platform.
5.2 Prices are subject to change at Dashfit’s discretion. Taxes may apply.
5.3 No Refund Policy: Once a program or service has been availed (in whole or in part), no refunds, cancellations, or transfers shall be made.
5.4 Exceptions: Refunds may only be considered in cases of duplicate payments or proven technical errors, at Dashfit’s sole discretion.
6. Subscriptions and Renewals
6.1 If you subscribe to recurring plans, you authorize Dashfit to charge your payment method automatically at the start of each billing cycle until cancellation.
6.2 You may cancel auto-renewal via your account settings before the renewal date. No refunds will be issued for unused periods.
6.3 Dashfit may suspend or terminate your subscription for non-payment or violation of these Terms.
7. User Conduct
You agree not to:
(a) misuse the Platform for unlawful purposes;
(b) upload or distribute harmful, obscene, or offensive content;
(c) share, copy, or distribute Dashfit’s content without permission;
(d) harass or harm other users;
(e) attempt to hack, disrupt, or reverse-engineer the Platform.
8. User Content
8.1 You may submit feedback, testimonials, or progress information to the Platform.
8.2 By submitting content, you grant Dashfit a non-exclusive, worldwide, royalty-free license to use, display, and share such content for business and promotional purposes, subject to our Privacy Policy.
8.3 You remain responsible for your content and warrant that it does not infringe third-party rights.
9. Intellectual Property
9.1 All intellectual property on the Platform, including workouts, videos, software, graphics, and designs, are owned or licensed by Dashfit.
9.2 No license or right is granted to you except for personal, non-commercial use of the services.
10. Third-Party Services
10.1 The Platform may integrate with third-party services (e.g., payment gateways, health trackers).
10.2 Dashfit is not responsible for the performance, policies, or practices of such third parties.
11. Disclaimers and Limitation of Liability
11.1 Services are provided on an “as-is” and “as-available” basis without warranties of any kind.
11.2 To the maximum extent permitted by law, Dashfit shall not be liable for:
(a) personal injuries or health issues resulting from participation in fitness programs;
(b) indirect, incidental, or consequential damages;
(c) interruptions, errors, or technical failures.
11.3 Your sole remedy for dissatisfaction with the Platform is to stop using the services.
12. Indemnity
You agree to indemnify and hold harmless Dashfit, its directors, employees, trainers, and affiliates from any claims, damages, or expenses arising from:
(a) your breach of these Terms;
(b) misuse of the Platform;
(c) participation in Dashfit programs.
13. Termination
13.1 Dashfit may suspend or terminate your account at any time for breach of these Terms, misuse of services, or conduct harmful to the Company or its users.
13.2 Upon termination, all licenses granted to you shall immediately cease.
14. Force Majeure
Dashfit shall not be liable for any delay or failure to perform due to causes beyond its reasonable control, including natural disasters, strikes, government actions, or internet outages.
15. Severability
If any provision of these Terms is found invalid, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Dashfit and supersede any prior agreements.
17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes shall be subject to arbitration in Mumbai, India, in accordance with the Arbitration and Conciliation Act, 1996. Subject thereto, the courts in Mumbai shall have exclusive jurisdiction.
